The final motion to move the ordinance was 4 in favor and 1 opposed. The motion began with discussion of returning the ordinance to the Planning Board<\/p>\n\n\n\n<p>When the board voted to move the PUD forward the initial discussion Planning Board Member Ryan Ouellette brought up several concerns:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>I think there were a lot of thing that were said tonight that I think were said tonight that were valuable and I know there were two documents, that one gentleman read it out, but there was another document that we didn&#8217;t really see and I think there is a lot of data there that, you know, that needs to be reviewed, and that&#8217;s just my opinion. I hate to keep pushing this down, and down, and down, but you know with the amount of feedback we got and write ins I don&#8217;t know if it makes sense to vote on it tonight &#8211; Ryan Ouellette Planning Board Alternate Member<\/em><\/p>\n\n\n\n<p>Vice Chair Art Rugg Responded:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>I would agree I think we need to take this back to the planning board for a workshop session because there is certainly some good input and I think collectively it would have a substantial effect and set it up and then have another hearing on this and then send it to the Town Council &#8211; Art Rugg Planning Board Vice Chairman<\/em><\/p>\n\n\n\n<p>Planning Board Member Tony DeFrancesco was unsure if it should move forward.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>Ah, I mean yah there is stuff, there is stuff here that we could change and there is some stuff that I don&#8217;t think is necessary. I think there is some stuff that, that, is is important but it&#8217;s already somewhere else it it so it doesn&#8217;t have to be here. Does that make sense? So I I don&#8217;t know, i don&#8217;t know. &#8211; Tony DeFrancesco Planning Board Assistant Secretary<\/em><\/p>\n\n\n\n<p>Town Council liaison Shawn Faber<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>It seams as this is one we had several public hearings that got to this point, I think if we push it out any further they&#8217;ll be cries of kicking the can down the road and all that. It this isn&#8217;t fully baked it goes to the Council as an opportunity to have an amendment or revision there. Ahm they can look at these comments &#8211; Shawn Faber Town Council Town Council Ex-Officio to the Planning Board<\/em><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Ryan Oullette asked if these comments would were going to go to the Town Council. Kellie Carron responded:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>So my intention is to, if you move this to council, would be to take the documents that Mr Carson and Deb provided and make sure that I give those to the full council as well so they have time to digest it and then the purpose of there is first reading would be to have that dialog, similar to a work session at the planning board that&#8217;s what I envision that first reading to look like and they&#8217;ll give the feedback as they see fit at that time. I&#8217;m sure they will have other feedback as well and go from there. That that&#8217;s how I envision it going if you move it to the council, but that&#8217;s just me &#8211; Kellie Caron Deputy Town Manager \/ Director of Economic Development<\/em><\/p>\n\n\n\n<p>Rugg stated that either way it would accomplished<\/p>\n\n\n\n<p>Anne Chiampa responded<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>I prefer to have another meeting on it, I couldn&#8217;t even see on my scree here the corrections &#8211; Anne Chiampa Planning Board Member<\/em><\/p>\n<\/blockquote>\n<\/blockquote>\n<\/blockquote>\n<\/blockquote>\n<\/blockquote>\n<\/blockquote>\n<\/blockquote>\n<\/blockquote>\n\n\n\n<p>Here is the full video and discussion of why the Planning Board moved the ordinance. The consensus was that this ordinance needed to get done. It&#8217;s important to note that two residents submitted 10 pages of recommendations that were not reviewed by the board prior to the vote.<\/p>\n\n\n\n<p>It also important to not that a majority of the Town Council had little interest is reviewing or discussing the documents or public input at their <a href=\"https:\/\/townunderground.com\/?p=11798\" data-type=\"link\" data-id=\"https:\/\/townunderground.com\/?p=11798\">first reading<\/a>. Is the Town Council going to discuss and review residents input as the Planning Board clearly indicated that was the intention of moving the PUD forward?<\/p>\n\n\n\n<p>Public Comment at the Planning Board <\/p>\n\n\n\n<p>Name: Deb Paul<br>Paul referred to suggested changes she emailed to the Board and Staff, and asked that they be attached to the minutes<\/p>\n\n\n\n<p>Name: Ray Breslin<br>R. Breslin asked about the benefit of PUDs to Londonderry. He asked if the Board can take into account citizen input at public hearings. He asked what changed from the original ordinance and T. DeFrancesco read the summary of changes.<\/p>\n\n\n\n<p>Name: Glenn Douglas<br>G. Douglas asked if the Board read the current draft before this public hearing. He asked if this meeting was being recorded. He spoke to the difficulty he had finding the summary of changes. K. Caron explained the Board did see this draft before this meeting; the meeting is being recorded but is not being broadcast live; and pointed out the location of the summary of changes online.<\/p>\n\n\n\n<p>Name: Dave Robbins<br>D. Robbins recommended defining &#8220;active and substantial development&#8221; in 5.2.4.H.4. K. Caron noted this is defined in the Town&#8217;s site plan regulations, and suggested adding the citation to the ordinance. D. Robbins asked about &#8220;community benefit&#8221; and suggested ensuring developers understand the definition. He suggested a phased approach in permitting would ensure a balance between construction of  commercial and residential components. K. Caron explained this is addressed in the PUD Master Plan regulatory documents; subsequent site plans would not be approved if the developer was out of compliance.<\/p>\n\n\n\n<p>Name: Marge Badois<\/p>\n\n\n\n<p>M. Badois asked if the Conservation Overlay District is considered a buffer. K. Caron said it is; the overlay district is discussed during presentation of proposed PUD. M. Badois noted the purpose of the overlay district is to protect the water. She spoke to the impact of increased density and suggested it be made more difficult not to respect the buffer. K. Caron noted language has been added addressing justification for modifications\/waivers from zoning.<\/p>\n\n\n\n<p>Name: Martha Smith<br>M. Smith asked if a PUD ordinance is required by the state. K. Caron referred to the innovative land use statute, which allows planning boards to adopt more flexible provisions by way of zoning ordinance. M. Smith asked about the benefit of a PUD to Londonderry. The Board explained it allows more flexibility for planning and for the creation of a village district, and provides the Board more control. M. Smith asked about the developer&#8217;s need to understand the Town&#8217;s regulations when proposing a PUD. The Board reviewed the process involved in considering and approving developments.<\/p>\n\n\n\n<p>Name: Kristine Perez<br>K. Perez expressed concern over vague terms and requested criteria be put around them. She asked clarifying questions about issues including the relation of public amenities and public infrastructure; the timeframe of the beginning of active and substantial development; the Board requiring a community input session prior to an application being submitted; the zoning districts where PUD can be proposed; who monitors compliance; and<br>protection of conservation buffers.<\/p>\n\n\n\n<p>Name: Leo Lee<br>L. Lee suggested developers should pay for associated infrastructure improvements.<\/p>\n\n\n\n<p>Name: Gregory Carson<br>G. Carson address concern about issues including the definition of community benefit, the density bonus structure, the two-year expiration period, the phasing language, and the discretion of the Planning Board. (<strong>TownUndeground Note the minutes do not reflect Carson submitted 5 pages of recommendations)<\/strong><\/p>\n\n\n\n<p>The Board questioned if changing the two-year timeframe in 5.2.4.H.4 would be considered a substantive change. K. Caron said this change could be made, as the section states &#8220;or within another timeframe.&#8221;<\/p>\n\n\n\n<p>Name: Ray Breslin<br>R. Breslin asked if the PUD Master Plan is a legal and binding contract between the Town and the developer and was told it was, once it is approved by the Planning Board. It can be amended, if both parties agree and it goes through the appropriate process. He expressed concern about the impact of stormwater runoff and culvert replacement in PUDs.<\/p>\n\n\n\n<p>Name: Deb Paul<\/p>\n\n\n\n<p>D. Paul asked how the responsibility for issues such as road plowing would be decided between multiple owners, once a PUD is established. The Board explained there would be an agreement between the original owner and future property owners. D. Paul suggested all PUDs should be subject to a development agreement. The Board agreed this would be a Town Council decision.<\/p>\n\n\n\n<p>Name: Gregory Carson<br>In response to D. Paul&#8217;s comment, G. Carson explained that a PUD overlay continues with the land, regardless of the number of subdivisions.<\/p>\n\n\n\n<p>A. Rugg closed public comment.<\/p>\n\n\n\n<p>The Board discussed whether to hold a workshop and another public hearing in light of the public input around the ordinance, or whether to send it to the Town Council to obtain their input and perspective.<\/p>\n\n\n\n<p>T. DeFrancesco made a motion to move this to the Town Council with the change that the Board agreed to and the documentation from public comment. R. Ouellette seconded the motion. The motion carried 4-1-0.
