Added Committee of Conference final vote

9/15/2026 Londonderry NH school board meeting explores the potential impacts of the HB 1300 Taxpayer Protection Act, a proposed New Hampshire mandate requiring voters to decide on local property tax caps. School officials express deep concern that the prescribed ballot language is misleading because it suggests classroom services will remain unaffected despite inevitable multi-million dollar budget shortfalls. Participants argue that the legislation utilizes a “one-size-fits-all” formula that fails to account for rising fixed costs like special education, transportation, and health insurance. There is also significant discussion regarding the legal challenges currently facing the bill and the confusion surrounding how specific administrative spending limits will be calculated. Ultimately, the speakers emphasize that these caps could undermine local control and force deep personnel cuts, threatening the quality of public education. The board concludes by urging proactive community engagement to ensure residents understand the long-term financial consequences before voting in November.

Londonderry State Representatives voting on HB 1300:
House Roll Call taken on 3/11/2026
Tom Dolan, Excused
Ron Dunn, Excused
David Lundgren, Excused
Wayne, MacDonald, Yea
Doug Thomas, Yea
Julius Soti, Yea
Sherm Packard, Presiding
Kristine Perez, Nay

Senate Roll Call taken on 6/4/2026
Sharon Carson, Yea

Adopt Committee of Conference Report
House Roll Call taken on 6/4/2026
Tom Dolan, Yea
Ron Dunn, Yea
Wayne, MacDonald, Yea
Doug Thomas, Yea
Julius Soti, Yea
Sherm Packard, Presiding
David Lundgren, Nay
Kristine Perez, Nay

HB 1300 was signed by Governor Ayotte 07/15/2026; Chapter 324; eff. If approved, the cap would generally limit local school property-tax growth to inflation plus new construction and impose a 6% cap on SAU central-office administrative spending.

Two New Hampshire residents, Kelly Wieser of Campton and David Bates of Warner, filed suit in Merrimack County Superior Court seeking to prevent the HB 1300 question from appearing on the November ballot. New Hampshire Bulletin Lawsuit seeks to strike down tax-cap ballot question before November

Their principal arguments are that the ballot question:

is confusing and misleading;

doesn’t adequately explain the potential effects of the tax caps;

allegedly makes a misleading statement that the caps won’t affect classroom instruction or school-based services;

doesn’t give voters all of the choices contemplated by the statute; and

therefore violates the New Hampshire Constitution’s protections concerning the right to vote.

Important development: the judge just ruled on September 16, 2026, Merrimack County Superior Court Judge Daniel St. Hilaire rejected the plaintiffs’ request for an emergency preliminary injunction.

That means the judge did not remove the HB 1300 question from the November 3 ballot at this stage. The court concluded that the plaintiffs had not demonstrated a sufficient likelihood of succeeding on the merits or an immediate irreparable harm warranting an injunction. InDepth Judge Rejects Injunction to Block School Budget Cap Vote

However, this is important: the ruling did not end the lawsuit or decide all of the constitutional claims. The plaintiffs could seek an expedited appeal to the New Hampshire Supreme Court.

The actual statute is RSA 32:5-i, created by HB 1300. It specifically gives taxpayers standing to enforce the law in Superior Court, so there could potentially be additional litigation over how the tax cap is implemented even if the November ballot question survives.

Related Articles
Judge Rejects Injunction to Block School Budget Cap Vote
Judge’s ruling clears way for school tax cap question to appear on NH ballots
Judge considers lawsuit to block local school tax cap question from November ballot

Correction: 9/17/2026.
