The public hearing held on 7/25/2024 on an application for Certificate of Approval for the removal of the 42’x 32’ barn located at 2 Litchfield Road resulted in a unanimous vote to reject the application without prejudice.
The applicant argued that the barn is unsafe and must be removed claiming the cost to restore the barn is approximately $700,000, which is financially impractical.
Resident Dave Ellis stated that the application is not compliant with the ordinance. Ellis stated that section 4.6.2. 8 C of the Londonderry Zoning regulation requires a report from a register professional engineer or architect, Ellis noted that the Town Building inspector is not an engineer or architect.
Ellis also noted that a complete restoration is not required. Ellis also noted that, in his opinion, there was no evidence that any maintenance of the building had been done since 2017. Ellis believes the applicant is in breech of the town easement.
The Commission voted unanimously to disapprove the application without prejudice. The applicant may reapply in the future.
