Former Town Manager Shaun Mulholland sued Londonderry Wednesday, alleging his Sept. 21 termination violated his rights.
Mulholland was removed from his position by the Town Council about three weeks ago following months of tension between him and some elected officials.
Ben King, the attorney representing Mulholland, called the decision to remove his client invalid and based on an “erroneous” legal opinion.
King filed the complaint in Rockingham Superior Court Wednesday, saying officials also breached the protections in his client’s employment contract.
Mulholland is asking the court to declare his termination invalid and find the town liable for breaching his contract. He’s also seeking damages for lost wages, employment benefits and other damages, plus attorney fees.
Council Chairman Ron Dunn gave several reasons for terminating Mulholland at the September meeting. These included several disputes, as well as Mulholland allegedly obstructing a Town Council investigation into him involving “allegations of serious misconduct.”
The town charter says a supermajority of four votes is needed to remove the town manager, but Mulholland was fired on a 3-2 vote. The Town Council acted on a legal opinion saying state law, which allows a simple majority, preempts the charter.
King said the town charter does not need to have the same terms for removing a town manager as the provisions in state statutes. He said the difference in necessary votes is a form of “additional municipal regulation,” which is authorized under state law.
