The Londonderry Town Council released findings from two investigations of former Town Manager Shaun Mulholland on Wednesday.
Officials hired two attorneys to investigate anonymous complaints that Mulholland broke federal employment anti-discrimination laws during his time as town manager. Both lawyers concluded there was no evidence to support those claims.
However, attorney Chris Vrountas said Mulholland violated the Town Charter and policies, and interfered with the investigations of his conduct.
Vrountas’s findings also said there was enough evidence to support allegations of bullying and retaliatory conduct by Mulholland, and that Mulholland was dishonest with town councilors.
Vrountas and another attorney, Eric Maher, conducted the two independent investigations of Mulholland this year.
Both noted Mulholland’s conflicts with Tom Roy, a former IT coordinator for the Londonderry Police Department, and Police Chief Kim Bernard, who replaced Mulholland as acting town manager immediately after he was terminated Sept. 21.
Vrountas’s report says Mulholland pushed to merge the town and police IT departments. This restructuring, adopted by the Town Council in April, allegedly contributed to Roy’s decision to resign and a widening divide between Mulholland and Bernard, according to the report.
The Londonderry Association of Police Supervisors filed an unfair labor practice complaint against the town related to Roy’s resignation.
Mulholland was accused of interfering “with the Town’s response to the (Public Employee Labor Relations Board) complaint, failing to recuse himself as required and instead putting his own interest in defending his personal conduct ahead of the Town’s interest in resolving the complaint,” Vrountas wrote.
When asked for comment, Mulholland said he was not aware he allegedly interfered with this case, and said he needed time to review Vrountas’s report.
Mulholland was also accused of obstructing Vrountas’s investigation by emailing town employees, telling them not to respond to his calls, the report says. Mulholland previously said the Town Council did not follow the procedures to initiate an investigation, so he assumed these were scam calls.
Vrountas’s investigation report is more than 400 pages long and is available alongside Maher’s report at londonderrynh.gov/investigation.
The Town Council hired Maher in January to investigate an anonymous report through an online complaint portal, stating that Mulholland invited Town Councilor Dan Bouchard to a daily operational meeting at Town Hall in an effort to “intimidate the employees.”
Maher concluded the claim was unsubstantiated.
