James Madison warned us that factions could capture representative government and turn it against the people. Alexander Hamilton warned that when representatives misrepresent themselves, republican virtue collapses. And Thomas Jefferson believed government closest to the people is the healthiest form of democracy.
At the town level, New Hampshire has always trusted its citizens. We decide zoning by warrant article. We govern by town meeting — the purest form of self-rule still alive in America. Yet Concord now steps in to override those votes, not because the people asked them to, but because a faction in the State House wants to impose an ideology.
They aren’t governing as Republicans or Democrats — they’re governing as Free Staters. And their goal is clear: dismantle local control. The Founders would recognize this as exactly what Madison feared — a faction hijacking representative government to silence the will of the people.
And we see the results already: recently enacted Free State laws have rendered much of our local zoning ineffective.
That’s why this moratorium matters. It’s not just about building permits — it’s about whether Windham governs Windham, or whether Concord governs Windham.
